Overview

These Terms and Conditions govern your access to and use of the Trent Web Studio website and any website design, online presence, and monthly care services offered through it.

Trent Web Studio is operated by The Truly Disciplined. By using the website, requesting a quote, submitting business details, purchasing a service, or continuing with a paid project, you agree to these Terms.

Plain-English summary: We provide practical website setup, basic online presence cleanup guidance, and ongoing monthly website care. We do not guarantee rankings, leads, revenue, or specific business outcomes.

Definitions

  • Company, we, us, or our means The Truly Disciplined, operating the Trent Web Studio brand.
  • Website means the Trent Web Studio website, currently accessible at https://trentwebstudio.com/.
  • Service means the website setup, design, online presence cleanup guidance, monthly care, maintenance, support, and related services offered by Trent Web Studio.
  • Customer, client, you, or your means the individual or business using the Website, requesting services, or purchasing services from us.
  • Monthly Care means ongoing website care, hosting support, maintenance, troubleshooting, and up to 60 minutes of routine content updates during each paid monthly billing period, subject to the scope described in these Terms and at purchase.

Services Provided

Trent Web Studio provides services that may include website planning, website setup, website design, basic copy organization, mobile-friendly page structure, contact path setup, hosting support, domain connection support, and basic Google Business Profile cleanup guidance.

Monthly Care may include up to 60 minutes of routine content updates during each paid monthly billing period, basic maintenance, hosting support, form/contact link checks, troubleshooting, and keeping the website handled according to the scope described at purchase or agreed in writing.

Advanced SEO, paid ads, social media management, ecommerce, booking systems, custom software, complex integrations, large redesigns, branding packages, photography, and major content rewrites are not included unless specifically agreed in writing.

Monthly Care Updates and Scope

Included update time: Standard Monthly Care includes up to 60 minutes of routine content updates during each paid monthly billing period.

Routine content updates may include reasonable changes to existing text, photos, contact information, business hours, services, links, or similar content within the website's existing structure.

Update requests may be grouped into one or two batches for efficient completion. Unused update time does not roll over, transfer, or accumulate into a future billing period.

New pages, major layout changes, redesigns, advanced features, third-party integrations, extensive copywriting, ecommerce, booking systems, custom development, and other work outside the existing website are not included. Additional work will be quoted separately and requires the Client's approval before it begins.

Trent Web Studio may determine whether a request qualifies as a routine content update based on its complexity, risk, required tools, and estimated completion time. If a request is expected to exceed the included update time, Trent Web Studio will notify the Client before beginning separately billed work.

AI-Assisted Tools and Production Methods

Trent Web Studio may use artificial intelligence-assisted tools, templates, automation, code libraries, stock assets, and other third-party software to assist with website planning, written content, design, coding, image creation, testing, deployment, maintenance, and related services.

Trent Web Studio reviews and customizes final deliverables before publication. The Client is purchasing the completed deliverables and managed service described at checkout, not a particular number of manual labor hours or a guarantee that every component was created entirely by hand.

The Client is responsible for reviewing and approving business information, factual claims, service descriptions, pricing, contact information, images, logos, testimonials, and other website content before launch or promptly after delivery.

No Ranking, Lead, or Revenue Guarantees

No Revenue Guarantee: Provider does not guarantee any specific number of website visitors, leads, customers, rankings, sales, or revenue.

We make websites and online presence elements clearer, more credible, and easier for customers to use. However, we do not guarantee search rankings, Google Business Profile placement, phone calls, quote requests, sales, revenue, customer growth, or any specific business result.

Business outcomes depend on many factors outside our control, including market demand, competition, pricing, reviews, reputation, responsiveness, business operations, location, seasonality, advertising, third-party platforms, and customer behavior.

Orders, Payments, and Subscriptions

Paid services may be purchased through Stripe Checkout, Payment Links, invoices, or another payment method we make available. You agree to provide accurate billing and contact information and confirm that you are authorized to use the payment method provided.

Unless a different written agreement applies, the starting payment covers the initial website setup/build and the first month of service as described at checkout. After that, Monthly Care renews automatically at the recurring price shown at checkout until canceled according to these Terms or any separate written agreement.

Prices, service names, and included features may change over time, but changes will not retroactively change a paid period already purchased.

Cancellations and Refunds

Unless otherwise stated in writing, there is no long-term commitment for the standard Monthly Care service. The Client may cancel Monthly Care at any time by emailing [email protected]. Cancellation becomes effective at the end of the Client’s current paid billing period. To avoid the next recurring charge, the cancellation request must be received before the next scheduled billing date.

30-Day Monthly Care Guarantee: The Client may request a refund of the initial $100 Monthly Care payment within 30 calendar days after the website is first launched by emailing [email protected].

The $100 website setup fee becomes non-refundable once work begins and is not included in the 30-Day Monthly Care Guarantee. Domain-registration fees and other third-party expenses purchased specifically for the Client are also non-refundable when disclosed before purchase.

If a refund is issued under the 30-Day Monthly Care Guarantee, Monthly Care, hosting, maintenance, updates, troubleshooting, and support may be discontinued, and the website may be taken offline unless alternative hosting is arranged.

After the 30-day guarantee period ends, Monthly Care payments for billing periods that have already begun are non-refundable, except where required by law or where Trent Web Studio agrees otherwise in writing. The Client may cancel Monthly Care at any time, and future monthly charges will stop. Service will continue through the end of the current paid billing period.

Upon cancellation and payment of any outstanding balance, the Client’s domain will be transferred or released upon request. The Client may also request a copy of transferable, client-specific website files. Trent Web Studio retains ownership of reusable templates, tools, code libraries, and licensed or non-transferable third-party materials. Migration, configuration, or setup with another hosting provider is not included unless separately agreed in writing.

Client Responsibilities and Approval

Client Approval: The Client is responsible for reviewing and approving all business information, factual claims, images, services, prices, contact details, form fields, legal notices, and final website materials before launch and after any material update.

The Client must provide accurate, complete, and lawful business information, including contact details, service descriptions, images, logos, reviews, testimonials, licensing claims, prices, policies, and other content requested for the website.

The Client represents that it owns or has permission to use all content, logos, photographs, testimonials, trademarks, business names, and other materials supplied to Trent Web Studio. The Client must promptly identify and request correction of any inaccurate, outdated, misleading, unlawful, infringing, or unauthorized material.

The Client is solely responsible for its business operations, customer service, advertising claims, pricing, warranties, licenses, permits, insurance, professional duties, accessibility obligations, recordkeeping, customer communications, and compliance with laws and industry requirements applicable to the Client.

Publication, continued use of the website, or written approval of a draft constitutes the Client’s approval of the website content and configuration then presented, except for defects Trent Web Studio knowingly concealed or obligations that cannot legally be shifted to the Client.

Legal Compliance and No Legal Advice

No Legal Advice: Trent Web Studio is not a law firm and does not provide legal advice. Any privacy policy, terms, disclaimer, accessibility statement, consent language, or other legal-policy text supplied by Trent Web Studio is a customizable starting template provided for convenience, not a legal opinion or guarantee of compliance.

The Client is responsible for determining which laws, regulations, notices, disclosures, licenses, consent mechanisms, retention rules, accessibility requirements, industry-specific duties, and customer-rights procedures apply to the Client, its website, its location, and its customers.

Before launch, the Client must review and approve all legal-policy pages and notices and is encouraged to have them reviewed by a qualified attorney. The Client is responsible for keeping those materials accurate as the Client’s business practices, services, locations, vendors, data uses, or legal obligations change.

Trent Web Studio does not warrant that a website, privacy policy, terms page, cookie notice, form notice, accessibility feature, or other supplied material will satisfy every law, regulation, platform rule, or industry requirement. The Client must notify Trent Web Studio in writing of any legal or compliance requirements the Client wants technically implemented.

Nothing in these Terms relieves Trent Web Studio of responsibility for performing its expressly agreed technical services with reasonable care or for obligations that cannot lawfully be waived or transferred.

Customer Inquiry Data and Privacy

If the Service includes a contact, service-request, appointment-request, or similar form, the Client determines what information is requested and the lawful business purposes for which the information will be used. The Client is responsible for the legality of its collection, use, retention, disclosure, deletion, and communication practices.

The Client is responsible for reviewing and approving its customer-facing privacy policy, form notices, consent language, and communication practices before launch. The Client must provide accurate information about its actual practices and promptly notify Trent Web Studio before changing form fields, adding analytics or advertising tools, collecting new categories of information, or materially changing how customer information is used.

Trent Web Studio may configure and maintain website forms, hosting, email delivery, spam protection, analytics, and related providers only as needed to perform the agreed Service. Trent Web Studio will not sell customer inquiry information or use it for Trent Web Studio’s unrelated marketing.

Unless otherwise agreed in writing, form submissions will be delivered directly to an account or system controlled by the Client. Trent Web Studio will not intentionally keep a separate permanent customer database, although temporary provider logs, backups, security records, or limited troubleshooting access may exist as part of operating the Service.

The Client agrees not to use an ordinary website inquiry form to request or collect Social Security numbers, driver’s-license information, payment-card or bank information, financing applications, insurance documents, account passwords, medical information, or other sensitive information unless the parties first enter a separate written agreement and use a system appropriate for that information.

The Client is responsible for obtaining any consent required for calls, emails, text messages, automated communications, advertising, recording, or marketing. A general service-request submission must not be treated as permission for unrelated marketing unless an appropriate, separately approved consent mechanism is used.

Each party is responsible for protecting the accounts, devices, credentials, records, and systems within its possession or control. The Client must use reasonable account security, including strong passwords and multi-factor authentication when available. Each party will notify the other promptly after confirming a security incident involving customer inquiry information within that party’s possession or control and will reasonably cooperate in responding to the incident.

Third-Party Services

The Service may use third-party platforms or providers, including payment processors, domain registrars, hosting providers, email tools, analytics tools, Google Business Profile, map listings, telephone services, form processors, spam-prevention tools, and deployment platforms.

Third-party services are governed by their own terms, privacy policies, availability, pricing, and technical limitations. Trent Web Studio does not control and is not responsible for third-party outages, policy changes, account restrictions, ranking changes, review removals, billing changes, data practices, or service limitations, except to the extent a loss is directly caused by Trent Web Studio’s failure to use reasonable care in selecting, configuring, or maintaining a provider within the agreed scope.

The Client authorizes Trent Web Studio to use reasonably selected third-party services necessary to perform the agreed work. Where an account is intended for the Client’s long-term use, the Client should own or control that account and is responsible for accepting the provider’s terms, maintaining payment information, protecting credentials, and complying with the provider’s rules.

Content, Domains, and Intellectual Property

The Client retains ownership of original materials supplied by the Client, including its business name, logo, photographs, testimonials, written materials, trademarks, and other business content.

Unless otherwise agreed in writing, the Client owns any domain name that the Client already owned before working with Trent Web Studio.

If Trent Web Studio purchases or registers a domain name specifically for the Client, Trent Web Studio may initially manage that domain on the Client’s behalf. If the Client cancels the Service and all outstanding amounts have been paid, Trent Web Studio will reasonably cooperate with transferring control of that domain to the Client, subject to registrar rules, required account information, transfer waiting periods, and any disclosed third-party transfer or renewal costs.

After all required setup payments are complete, the Client receives a non-exclusive license to use the final paid website deliverables for the Client’s own business.

Trent Web Studio retains ownership of its reusable templates, code libraries, internal systems, development tools, processes, methods, drafts, and materials that were not created exclusively for the Client. The Client may not resell, redistribute, copy, extract, or reuse those materials as a competing website or technology service without written permission.

Hosting, maintenance, technical support, and future updates require an active Monthly Care subscription. Upon cancellation and payment of any outstanding balance, the Client may request a copy of transferable, client-specific website files. Trent Web Studio retains ownership of reusable templates, tools, code libraries, internal systems, and licensed or non-transferable third-party materials. Migration, configuration, troubleshooting, or setup with another hosting provider is not included and may be quoted separately.

Termination

We may refuse, suspend, or terminate services if a payment fails, a chargeback is opened, requested work is unlawful or deceptive, required information is not provided, you misuse the Service, or you breach these Terms.

Upon termination, your access to active work, maintenance, hosting support, updates, or related services may end. Any outstanding amounts remain due unless waived in writing.

Client Indemnification

To the fullest extent permitted by law, the Client agrees to defend, indemnify, and hold harmless Trent Web Studio and The Truly Disciplined from third-party claims, demands, penalties, losses, liabilities, and reasonable costs, including reasonable attorneys’ fees, to the extent arising from:

  • content, materials, instructions, claims, products, services, or business practices supplied, approved, or controlled by the Client;
  • the Client’s collection, use, retention, disclosure, security, deletion, or marketing use of customer information;
  • the Client’s failure to obtain required permissions, licenses, notices, disclosures, or consents;
  • alleged infringement or unlawful use of materials supplied or approved by the Client; or
  • the Client’s violation of applicable law, regulation, professional duty, or third-party terms.

This indemnification does not apply to the extent a claim is finally determined to have resulted from Trent Web Studio’s own gross negligence, willful misconduct, knowing violation of law, or breach of an obligation that cannot lawfully be waived.

Limitation of Liability

To the fullest extent permitted by law, Trent Web Studio and The Truly Disciplined will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, search-ranking changes, platform issues, privacy-policy inadequacy resulting from inaccurate or incomplete Client-provided information, or interruption of business.

To the fullest extent permitted by law, the total aggregate liability of Trent Web Studio and The Truly Disciplined for claims related to the Website or Service is limited to the amount the Client paid directly to Trent Web Studio for the Service giving rise to the claim during the three months before the event giving rise to the claim.

These limitations do not apply where prohibited by law and do not exclude liability for fraud, willful misconduct, gross negligence, or other obligations that cannot lawfully be limited or waived.

Website Disclaimer

The Website is provided on an “as is” and “as available” basis. We do not warrant that the Website will be uninterrupted, error-free, secure, or free of harmful components.

Information on the Website is for general informational purposes and may be changed or removed at any time.

Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. Updated terms will be posted on this page with a revised “Last updated” date. Your continued use of the Website or Service after changes are posted means you accept the updated Terms.
